What is a whistleblower?

You are a whistleblower if you are an individual who reports or discloses, without financial consideration and in good faith, information concerning a crime (e.g. rape, homicide, etc.), a misdemeanor (e.g. moral or sexual harassment, corruption, abuse of corporate assets, etc.) or a threat or harm to the general interest. It may also concern a violation (or an attempt to conceal such a violation) of France's international commitments.

Is my alert protected by confidentiality?

Arkopharma guarantees the strict confidentiality of the identity of the whistle-blower, the person who is the subject of the whistle-blowing report and any other person named in the report, as well as the information collected in the report.


Information that could identify you as a whistle-blower may not be disclosed without your consent. They may, however, be passed on to the judicial authorities in certain cases. When the persons responsible for collecting or processing whistleblowing reports are required to report the facts gathered to the judicial authorities, the information identifying the whistleblower may also be communicated to them. In this case, you will be informed.

Can I send an anonymous alert?

It is possible to launch an alert anonymously. In this case, the facts must be sufficiently detailed to enable the alert to be processed. We recommend that you identify yourself in order to facilitate the actions required to manage your alert, it being understood that the confidentiality of your identity will be guaranteed in all cases.

What happens after an alert is sent out?

The Group Ethics and Compliance Manager will be notified of your alert via the system. You will receive an acknowledgement of receipt of your alert no later than 7 working days following receipt of the alert. The Alert Committee will then analyze the admissibility of your alert. If it is admissible, the Alert Committee will decide on the appropriate investigation strategy to ascertain whether or not the allegations are true. You will be kept informed of the progress of your alert via the secure messaging system (to do this, please keep the confidential code given to you when you make your alert).

How is the admissibility of my alert assessed?

The members of the Alert Committee collectively assess the admissibility of each alert in the light of the criteria laid down by law and the current procedure for collecting and processing alerts. In particular, they check whether you meet the definition of a whistle-blower (good faith and absence of financial consideration) and whether the facts reported fall within the scope of the whistle-blowing system.

What action can be taken on my report?

If your alert is admissible, it will be processed by the people in charge of the investigation, appointed by the Alert Committee. These may be internal or external players (e.g. lawyers, consultants specializing in digital forensic or professional alert investigations). An internal or external investigation will then be carried out to verify whether or not the allegations reported are well-founded.


If your alert is not admissible, you will be informed of the reasons why the report does not comply with the legal conditions. It will then be closed and archived in compliance with current regulations on personal data.

Important

You can report :

- conduct or situations contrary to the Arkopharma Ethics Charter or Arkopharma's internal ethics and compliance rules

- a crime or misdemeanor (e.g., moral or sexual harassment, corruption, embezzlement, etc.)

- a violation or attempted concealment of a violation of a law or regulation

- a threat or harm to the public interest.


The confidentiality of your identity, the facts reported and those of the person(s) targeted by the alert will be preserved during the process of collecting and processing the alert. You can also choose to remain anonymous. In this case, the facts must be sufficiently detailed and explicit to enable the report to be processed.


Your report will be received by the Group's Ethics and Compliance Manager, who will refer it to the Alert Committee (see list of referrers) to examine its admissibility in the light of the procedure in force and legal conditions, and to decide on the follow-up to be given to your alert. All reports will be rigorously analyzed by the investigation team. Arkopharma reserves the right to call on external partners to handle alerts.

Each alert has its own discussion system for sending and receiving messages. These exchanges respect the choice of the authors of alerts if they wish to remain anonymous.


Only designated referrers will receive the information you send via the form. You will be able to track your report and communicate with the referent(s) using the confidential code generated by the platform when you submit your report.
